These General Terms and Conditions (GTC) apply to the use of the software-as-a-service platform Flowtifyy, operated by KOMUNIQUE by Philipp Roth, Blumenrainstrasse 29, 9050 Appenzell, Switzerland (hereinafter "Provider"). By registering and using Flowtifyy, the user (hereinafter "Customer") agrees to these GTC.
Flowtifyy provides a web-based platform for integrating online shops into Webflow websites and other web pages. The Provider enables the Customer to manage products, receive orders and offer various payment methods. Access is via web browser or as a Progressive Web App (PWA).
The scope of services is determined by the chosen pricing plan (Free, Basic, Pro or Unlimited). Current plan features are available at app.flowtifyy.com.
The contract is formed upon registration by the Customer. The Customer undertakes to provide truthful and complete information and to keep it up to date. Passing on login credentials to third parties is not permitted.
Current prices are published on the website (in CHF, excl. VAT). Paid plans are billed via Stripe. By subscribing to a paid plan, the Customer authorises the Provider to collect the applicable fees via the specified payment method.
Annual subscriptions are billed 12 months in advance. Monthly subscriptions renew monthly. All plans include a 7-day free trial period (except the Free plan).
The Customer may cancel their subscription or change their plan at any time via the customer portal. Upon cancellation, access remains active until the end of the paid period. No pro-rata refunds are provided for unused periods.
The Provider may terminate the contractual relationship with 30 days' notice. The right to extraordinary termination for serious breaches is reserved.
Paid plans begin with a 7-day free trial period. After the trial period ends, the subscription automatically continues under the chosen plan and billing cycle, unless the Customer cancels before expiry.
The Provider grants the Customer a non-exclusive, non-transferable licence to use the platform for the duration of the contract. All rights to the platform, code and the Flowtifyy brand remain with the Provider.
The Customer grants the Provider a non-exclusive right to store, process and display content entered by the Customer (products, images, texts) for the purpose of providing the service.

The Provider endeavours to maintain 99% availability on a monthly average (excluding planned maintenance). Planned maintenance will be announced in advance where possible. In the event of outages, claims for damages are excluded unless the Provider is guilty of gross negligence or wilful misconduct.
Personal data is processed in accordance with the Provider's Privacy Policy and the provisions of the GDPR and the Swiss Data Protection Act (DSG/FADP). By entering into the contract, the Customer consents to the processing of their data for the described purposes.
Where the Customer processes personal data of third parties (end customers) via the platform, the Customer is the controller under the GDPR and the Swiss DSG. The Provider acts as a processor. A data processing agreement (DPA) pursuant to Art. 28 GDPR and Art. 9 DSG can be issued on request at support@flowtifyy.com.
The Provider's liability for slight negligence is excluded. In cases of gross negligence or wilful misconduct, liability is limited to the amount actually paid by the Customer in the last 12 months. Any liability for indirect damages, loss of profits or consequential damages is excluded.
The Provider reserves the right to amend these GTC or prices with at least 30 days' notice. Changes will be communicated to the Customer by email. Continued use of the platform after expiry of the notice period constitutes acceptance of the amended terms.
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising from or in connection with this contract is Appenzell, Switzerland, provided the Customer is a merchant or has no general place of jurisdiction in Switzerland.
Should individual provisions of these GTC be invalid or unenforceable, this shall not affect the validity of the remaining provisions. Invalid provisions shall be replaced by those that come closest to the economic purpose of the invalid provision.
